Terms of Service
These terms apply to anyone who uses the Lumomatics website or buys our services. Please read them before booking an audit or engaging us for any work.
1. Who we are
Lumomatics is operated by John Costabile, ABN 13 142 760 466.
In these terms, "we", "us", and "our" mean Lumomatics. "You" means you, the person or business using our website or buying our services.
2. Our services
We provide workflow consulting and AI-related services for small businesses, including:
- The Workflow Clarity Audit (a fixed-scope review and report)
- Done-with-you and done-for-you implementation services
- Ongoing optimisation and support packages
The specific deliverables, timeframes, and prices for each service are described on our website at the time of purchase, or in a written quote where applicable.
3. Booking and payment
Workflow Clarity Audit: payable in full at the time of booking via Stripe, or by invoice on agreement.
Implementation and other services: quoted separately. Payment terms will be set out in the quote — typically 50% on engagement and 50% on delivery for fixed-scope work, or monthly in advance for ongoing support.
All prices are in Australian Dollars (AUD). [GST is included where applicable / Lumomatics is not currently registered for GST.]
4. What you'll receive
For the Workflow Clarity Audit, you'll receive the deliverables described on our website at the time of booking — typically a workflow pain map, top 3 recommendations, a recommended quick win, AI prompts and templates, an implementation roadmap, and tool recommendations.
We aim to deliver within 7 days of receiving your completed intake questionnaire. We'll let you know if anything will take longer.
For other engagements, deliverables and timeframes are set out in the quote.
5. What we need from you
To deliver our work properly, we need you to:
- Complete the intake questionnaire honestly and reasonably promptly
- Share the information, examples, or access we reasonably need to do the work
- Respond to our questions within a reasonable time
- Treat us professionally, as we will treat you
If we can't get the information we need from you, we may have to pause the engagement until we can.
6. Refunds and revisions
Workflow Clarity Audit
- Before delivery: full refund if you change your mind, less any payment processing fees
- Within 14 days of delivery: if you're not satisfied with the recommendations, tell us and we'll revise them at no extra cost
- After 14 days: the audit is considered accepted and is non-refundable
Implementation and other services
Refund and revision terms are set out in the relevant quote or engagement letter.
We don't offer partial refunds for completed work, but we will always try to make things right where we've genuinely fallen short. Talk to us first.
7. Intellectual property
Your information stays yours. Anything you share with us about your business — workflows, processes, customer information — remains your property.
Our deliverables become yours on payment. Once you've paid, you own the audit report, recommendations, prompts, and templates we've prepared specifically for your business. You can use them however you like internally.
Our underlying methods, frameworks, and templates remain ours. We may reuse general approaches, methodologies, and template structures across clients. Nothing in your engagement prevents us from doing similar work for other businesses, including in your industry.
We won't share information that would identify your business in any case study, example, or marketing material without your explicit permission.
8. Limits on what we promise
We do our work carefully and to a professional standard. But:
- Our recommendations are advice, not guarantees of business outcomes
- We can't promise specific time savings, revenue increases, or any particular result
- Implementation success depends on factors outside our control, including your team, your tools, and your follow-through
- Tool recommendations are based on our judgment at the time; tools change, prices change, and what fits today may not fit tomorrow
You're responsible for the decisions you make based on our advice, and for making sure any changes you implement comply with your own legal, tax, and regulatory obligations.
9. Liability
To the extent permitted by law, our total liability to you under any engagement is limited to the amount you've paid us for that engagement.
We're not liable for indirect, consequential, or special losses (including lost revenue or lost business opportunities), except where Australian Consumer Law says otherwise.
Nothing in these terms excludes any rights you have under the Australian Consumer Law that can't legally be excluded.
10. Confidentiality
We treat anything you share with us in the course of an engagement as confidential. We won't share it outside Lumomatics except with the third-party services we use to operate (listed in our privacy policy), or where we're legally required to.
The same applies to anything we share with you about our methods or pricing — please keep our quotes, templates, and unpublished materials confidential.
11. Cancelling an engagement
You can cancel at any time. If we've already started work, we'll calculate a fair amount for work completed and refund the balance.
We can cancel if you breach these terms, treat us or our work disrespectfully, or behave in a way that makes the engagement unworkable. In that case, we'll refund any unearned portion of what you've paid.
12. Website use
You can use the Lumomatics website for any lawful purpose. You can't:
- Copy or republish our content without permission
- Try to access parts of the site that aren't publicly available
- Use the site in any way that could damage or disrupt it
The website is provided "as is". We don't guarantee it will always be available or error-free.
13. Changes to these terms
If we change these terms, we'll update the "Last updated" date at the top. The terms that apply to your engagement are the ones in force when you booked.
14. Governing law
These terms are governed by the laws of Victoria, Australia. Any disputes will be dealt with in the courts of Victoria.
We'd much rather resolve disputes by talking. If something's gone wrong, email us first and let's see if we can sort it out.
